Workers Compensation Lawyers Perth WA
Injured at work in Perth or anywhere in WA?
You may be entitled to weekly payments, treatment costs and, in some cases, a lump sum or common law damages. In Western Australia, workers compensation is generally a no fault system, which means you usually do not have to prove your employer was at fault to make a claim. Step by Step Guidance through the Workers Compensation Claim Process
When you are injured at work, you should take the following steps:
Seek first aid and report the injury to your employer.
See a doctor of your choice and obtain a First Certificate of Capacity.
Complete a Workers Compensation Claim Form and give it with the certificate to your employer.
The employer has seven days to lodge the documents with their insurer; the insurer then has 14 days to decide on liability. Failure to meet these timeframes can result in deemed acceptance.
Our firm can assist with completing forms, collating medical evidence and liaising with insurers to avoid disputes. We monitor strict timelines and ensure the insurer makes a decision.
If the insurer does not issue a liability decision or a deferred decision within 14 days, your claim is deemed accepted if the claim is deferred and no decision is made within 120 days, it is also deemed accepted.
What can you claim?
If your claim is accepted, compensation may include:
weekly payments for lost wages
medical and allied health expenses
rehabilitation expenses
travel and other related expenses
compensation for permanent injuries
Failing to provide proper training.
Unsafe or faulty equipment.
Slips, trips and falls.
Ergonomic negligence
Manual handling.
Ignoring safety standards
Lack of supervision
Exposure to hazards
Unsafe facilities.
Neglecting maintenance of equipment and machinery
Exposure to toxic substances such as not controlling dust, silica exposure, diesel fumes, etc.
not supplying appropriate protective equipment.
Falling objects
Forklift accidents
Common Law Rights and Negligence
The statutory scheme provides basic benefits regardless of fault, but workers may be able to sue their employer for negligence.
To pursue common law damages, you must have at least a 15 % permanent whole of person impairment.
Unlike the statutory system, a common law claim requires proof of employer negligence. The injured worker must show that the employer breached their duty of care and that this breach caused the injury.
Examples of negligence include:
Clients must elect to pursue a common law claim by lodging a Common Law Election form and there are strict limitation periods.
After making this election, statutory entitlements reduce depending on your circumstances. Our lawyers evaluate whether a common law claim is in your best interest. We gather evidence of negligence, liaise with experts and negotiate with insurers.
We also assess and explain the trade off between continuing statutory benefits and the potential for higher damages through common law litigation. Because an election to sue is irreversible. We ensure clients make informed decisions.
You may not pay anything to us in legal fees until we secure your compensation. Our fees are based solely on the work we do once your claim is successful. At MPK Lawyers, we focus on providing cost effective, expert legal representation to help you get the outcome you deserve.
